Northern Ireland Compliance EPBD Regulations on TM44 Air Conditioning Inspection Reports.

ACI Reports are in dialogue with a number of Councils in Northern Ireland in response to the setting up of a "task force” in Northern Ireland, who’s remit appears to be to ensure that the Region has its building stock completely compliant with the EPBD Regulations on Air Conditioning Inspection Reports. Northern Ireland are the first Region in the UK to tackle non-compliance in large scale; this is being processed by the Building Control departments of each Local Council, who are sending letters out to non-compliant building operators. The number of letters being sent out has increased dramatically in recent weeks.

Trading Standards issue TM44 Air Conditioning Assessment non-compliance notices in Coleraine, Northern Ireland.

Coleraine in Northern Ireland is the next big push on TM44 Enforcement as ACI Reports can confirm that two of our large portfolio High Street clients have received notices in the district this last month. TM44 non-compliance notices are not something new in NI, there were a spate of them two years ago, mainly in Belfast. ACI Reports undertook a batch of emergency TM44 inspections at that time and are now doing the same in the Coleraine area.

Hampshire County Council Trading Standards set out their stance on TM44 Air Conditioning Compliance

In a statement issued by Hampshire County Council on their website in 2013, they show that they mean business when looking at those Companies which do not have their mandatory Air conditioning Inspection Reports in place. ACI reports have been supporting businesses in Hampshire to avoid what could be serious fines, and believe that planned approaches to TM44 compliance are the answer, not reacting to a £300 fine, which could be weekly for each building found without a certificate.

Incidence of TM44 Air Conditioning Assessments notices and emergency TM44's in the City of London and Canary Wharf on the increase

Trading Standards activity is on the increase in many areas of the UK, and ACI Reports have direct knowledge of e-mails and notices regarding TM44 Air Conditioning Inspections being sent out in Liverpool, Nottingham, Central London and Canary Wharf recently.

ACI Reports is able highlight that there are “moves afoot” to strengthen the enforcement of Air Conditioning Assessment Reports, with CIBSE and Accreditation bodies starting a new drive to push the DCLG into greater enforcement of the TM44 Air Conditioning Assessment Regulations. The Chartered Institution of Building Services Engineers (CIBSE) has highlighted a significant case where the lack of enforcement of Energy Performance of Building Regulations (EPB Regulations) has cost taxpayers 5.7m. At a time when energy policy is one of the most serious issues facing government, CIBSE argues that this non-compliance can be overlooked no longer.

At ACI Reports we have seen a noticeable increase of enquiries through our website in recent weeks, and this together with our existing client base, is giving us three or four new projects each day to price. Something is happening out there as the constant flow of instructions is increasing. What is happening; well we think that Trading Standards have been told to ramp up the pressure by Central Government – there is a Political “green” debate going on at the moment. This week we have seen a notice that is being sent out by not only Liverpool City Council Trading Standards, but also by a specialist Landlord Accreditation Officer. This notice not only covers off TM44 Air Conditioning Inspections, but also EPCs and DECs, and it looks serious.

Trading Standards hit Swansea on TM44 7 day notices.

ACI Reports have been contacted in the past two weeks by a number of our National Retail clients to say they had trading Standards call into their store asking for sight of the TM44 air Conditioning Assessment certificate. This was followed up by the issue of a “non-compliance” notice, and a request to provide the certificate within 7 days. Luckily, existing clients were able to call us and we have copies of all documents on secure servers, and could therefore respond straight away. One client, who we are undertaking a national rollout of TM44 certificates for, called us. We spoke to Trading Standards, informed them about the rollout and they were pleased to see that the client was aiming to complete all TM44s this year. The only request was that we send the Swansea report over as soon as we could.

HSE commence site checks on Legionella in Scotland – don’t get caught out with no TM44; you would be breaking the Law

The HSE and local authorities are carrying out visits and inspections to companies with cooling towers in the west of Scotland to ensure they are managing legionella risks appropriately. TM44 legislation also comes in to play in January 2013 (in Scotland) and whilst it is the remit of Trading Standards to issue fines, any check by HSE could very well include the request to see a TM44. Any company with Air Conditioning over 12kw per building must have an Air conditioning Inspection undertaken to comply with the law.

DCLG TM44 Policy update sets the scene for Trading Standards non - Compliance Notices, Enforcement, Fines

Policy update 5 issued not long ago deals with how CLG intend to start dealing with those Air Conditioning Operators who are flouting the law by not having a TM44 certificate in place. Mandatory lodgement came in this April, together with a revised TM44 and the policy update, which is a good informative update for effected Operators to read, the question & answer section gives a Government view. Reading between the lines, ACI are of the opinion that this is the start of a TM44 compliance campaign which will see more action. ACI Reports are getting increasing numbers of calls from building operators who have had a letter or visit from compliance officers.

Trading Standards Issue Notices For No TM44 Air Conditioning Inspection Certificates.

Liverpool City Council turn up the heat on TM44 Air Conditioning Inspections.

In a statement issued in Liverpool on 17th October, it has become clear that the council is taking its Air Conditioning Fines seriously;

“Liverpool Trading Standards have been offering advice to owners of buildings with air conditioning systems which are affected by these regulations, “ said Councillor Tim Moore, cabinet member for the environment and climate change.
